Acceptance of These Terms
These Terms of Use govern access to and use of the ECHOLOGISTS website, social and educational content, user accounts, memberships, tutoring, courses, quizzes, downloads, digital products, subscriptions, case submissions, images, videos, community features, and other services made available by ECHOLOGISTS.
By accessing or using ECHOLOGISTS, creating an account, making a purchase, submitting material, or selecting an option indicating acceptance, you agree to these Terms of Use.
Do not use the applicable feature or service if you do not agree to these terms.

About ECHOLOGISTS
ECHOLOGISTS is an educational platform operated by an individual based in Ontario, Canada.
ECHOLOGISTS focuses primarily on:
- echocardiography;
- diagnostic cardiac sonography;
- cardiovascular ultrasound;
- medical imaging;
- clinical interpretation;
- professional education; and
- related educational subjects.
ECHOLOGISTS is not an emergency service, healthcare facility, regulatory body, credentialing organization, university, college, or licensing authority.

Medical Disclaimer
All ECHOLOGISTS content and services are subject to the separate ECHOLOGISTS Medical Disclaimer.
Content is provided for general educational and informational purposes. It does not constitute individualized medical advice, diagnosis, treatment, prescription, or professional clinical direction.
Accessing ECHOLOGISTS does not create a healthcare professional–patient relationship.
Clinical decisions must be based on complete patient information, current evidence, professional judgment, institutional requirements, and the user’s authorized scope of practice.
For medical emergencies, contact local emergency services. In Canada, call 911 or attend the nearest emergency department.

Eligibility
You must be legally capable of accepting these Terms of Use.
A person who has not reached the age required to enter a binding agreement in their jurisdiction may use account, purchase, submission, tutoring, membership, or subscription features only with appropriate involvement and permission from a parent or legal guardian.
A parent or guardian permitting a younger person to use a paid or contractual service is responsible for supervising that use and for the applicable payment and account obligations.

Accounts
Some ECHOLOGISTS features may require an account.
You agree to:
- provide accurate information;
- keep information reasonably current;
- protect your password and login credentials;
- avoid sharing access with unauthorized persons;
- notify ECHOLOGISTS of suspected unauthorized access; and
- accept responsibility for activity conducted through your account unless caused by circumstances outside your reasonable control.
You may not:
- impersonate another person;
- create an account using false or misleading information;
- transfer or sell an account;
- use another person’s account without permission; or
- attempt to bypass access restrictions.
ECHOLOGISTS may suspend or restrict an account where reasonably necessary to investigate security concerns, misuse, non-payment, infringement, or violation of these Terms.

Educational and Professional Use
ECHOLOGISTS content may support education, review, professional discussion, or examination preparation.
It does not replace:
- formal education;
- supervised clinical training;
- competency assessment;
- institutional protocols;
- manufacturer instructions;
- current clinical guidelines;
- professional regulation;
- credentialing requirements; or
- independent professional judgment.
Users are responsible for confirming information against reliable and current sources applicable to their jurisdiction and professional role.

Intellectual Property
Unless otherwise identified, original content made available by ECHOLOGISTS is owned by or licensed to ECHOLOGISTS and is protected by applicable intellectual-property laws.
Protected materials may include:
- articles and educational explanations;
- captions, diagrams, illustrations, and graphics;
- videos and cine-loop edits;
- quizzes, cases, and downloadable resources;
- tutoring and course materials;
- page designs and website code;
- branding, logos, mascots, and visual systems; and
- compilations or arrangements of content.
The ECHOLOGISTS name, logos, branding, mascots, slogans, and distinctive visual elements may not be used in a way that suggests affiliation, endorsement, authorship, or authorization without written permission.
Third-party materials remain the property of their respective copyright holders and may be displayed under permission, licence, attribution requirements, applicable legal exceptions, or another lawful basis.

Limited Permission to Use Content
Unless a separate written licence states otherwise, ECHOLOGISTS grants you a limited, revocable, non-exclusive, non-transferable licence to access and use content for lawful personal and non-commercial educational purposes.
You may:
- view content;
- study content;
- refer to content during personal learning;
- share an official ECHOLOGISTS webpage or social-media link; and
- use a purchased resource according to its accompanying licence.
You may not, without prior written permission:
- reproduce substantial portions of content;
- republish content;
- remove copyright or attribution notices;
- distribute downloadable files;
- upload content to another website or platform;
- sell or sublicense content;
- modify content and present it as original;
- use content in a paid course, commercial product, or business;
- compile content into another resource;
- create unauthorized derivative products;
- systematically scrape or extract content;
- use content to train or develop an artificial-intelligence model or commercial dataset;
- bypass technical restrictions; or
- falsely represent an association with ECHOLOGISTS.

Acceptable Use
You agree to use ECHOLOGISTS lawfully and respectfully.
You must not:
- violate applicable law;
- interfere with website operation;
- attempt unauthorized access;
- introduce malicious code;
- test security without written permission;
- collect information about other users without authorization;
- engage in harassment, threats, or discriminatory abuse;
- post false, defamatory, deceptive, or unlawful content;
- infringe intellectual-property or privacy rights;
- submit confidential information without authority;
- publish identifiable patient information;
- manipulate quizzes, accounts, payments, or access controls;
- use automated systems that impose an unreasonable burden;
- misrepresent educational material as individualized medical advice;
- use ECHOLOGISTS content outside your legal or professional scope; or
- encourage another person to violate these Terms.

Comments and Community Participation
Public discussion features are intended for respectful educational exchange.
ECHOLOGISTS may moderate, edit, hide, restrict, or remove content that:
- discloses patient information;
- contains personal attacks;
- is misleading or dangerous;
- constitutes spam;
- infringes legal rights;
- promotes unauthorized services;
- contains irrelevant advertising;
- violates platform rules; or
- is otherwise inappropriate for the educational community.
Moderation decisions may be made at the discretion of ECHOLOGISTS. ECHOLOGISTS is not obligated to review every comment before publication and does not endorse every opinion expressed by a user.

Educational Submissions
Users may be invited to submit cases, images, videos, cine loops, diagrams, questions, captions, or other educational materials.
You retain any ownership rights you lawfully hold in your original submission.
By submitting material to ECHOLOGISTS, you grant ECHOLOGISTS a non-exclusive, worldwide, royalty-free licence to:
- receive, host, and store the material;
- reproduce, crop, resize, and format the material;
- annotate or edit the material for clarity, grammar, accessibility, or de-identification;
- translate the material;
- combine it with educational commentary;
- publish and publicly display it;
- distribute and promote it;
- share it through the website and social-media channels;
- incorporate it into educational compilations; and
- archive it.
This licence applies for educational, informational, promotional, and platform-related purposes and includes permission to use service providers where reasonably necessary to host, edit, distribute, or publish the material.
The licence does not transfer your ownership to ECHOLOGISTS.
Your Submission Promises
By submitting material, you represent that:
- you created it or have sufficient authority to submit it;
- the submission does not infringe another person’s rights;
- all required patient permissions, institutional permissions, and professional approvals have been obtained;
- the material has been appropriately de-identified;
- it does not contain information that could identify a patient;
- it does not violate confidentiality obligations;
- the information you provide about its source is accurate;
- the submission is lawful; and
- ECHOLOGISTS may use it as described in these Terms.
You permit reasonable editorial changes and acknowledge that attribution may be included, shortened, or omitted unless otherwise agreed in writing.
ECHOLOGISTS may accept or reject a submission, request further information, delay publication, edit the submission, remove identifying details, decline to provide a reason for non-publication, or remove previously published material.
A removal request may be submitted to support@echologists.com. ECHOLOGISTS will consider the request in good faith but may not be able to remove material that has already been lawfully distributed, incorporated into another resource, cached, archived, or retained for legitimate legal or recordkeeping purposes.

Submitted Patient and Clinical Information
Do not submit identifiable patient information through:
- comments;
- general contact forms;
- ordinary email;
- social-media messages;
- public uploads; or
- any feature not expressly approved for secure clinical submissions.
Removing only a patient’s name may not be sufficient to de-identify a case.
Contributors are responsible for checking:
- image overlays;
- video frames;
- report headers;
- DICOM metadata;
- file names;
- dates;
- accession numbers;
- facility names;
- identifiers;
- voice recordings; and
- surrounding clinical details.
ECHOLOGISTS may delete, reject, or restrict material believed to contain unauthorized personal or health information.

Purchases and Payments
Prices, currencies, included materials, and payment terms will be displayed at or before checkout.
Payments may be processed through Stripe, PayPal, or another disclosed payment provider.
You agree to provide accurate billing information and authorize the applicable provider to process the charge.
ECHOLOGISTS may:
- correct pricing errors;
- reject or cancel a transaction affected by an obvious error;
- limit quantities;
- suspend access following a failed or reversed payment;
- investigate suspected fraud; and
- issue refunds where required or approved.
You are responsible for taxes, currency-conversion charges, bank fees, or payment-provider charges that apply to your transaction unless otherwise stated.

Refunds, Cancellations, and Rescheduling
Refund, cancellation, subscription, and rescheduling conditions may vary by product or service.
The conditions displayed on the product page, in the service description, during checkout, in a booking confirmation, or in a separate refund or cancellation policy form part of these Terms.
Digital materials that have been delivered, downloaded, accessed, or substantially consumed may be non-refundable where permitted by law and where this condition was disclosed before purchase.
Tutoring sessions may be subject to notice requirements for cancellation or rescheduling where those requirements are disclosed during booking.
Nothing in these Terms removes any non-waivable consumer right available under applicable law.

Memberships and Subscriptions
Where a membership or subscription is offered, the following information will be presented before purchase where applicable:
- price;
- billing frequency;
- included content;
- renewal terms;
- cancellation method;
- trial conditions; and
- material restrictions.
An automatically renewing subscription will renew according to the disclosed billing interval until cancelled through the identified cancellation method.
Cancelling ordinarily prevents future renewal and does not necessarily produce a refund for an already completed billing period, unless otherwise stated or required by law.
ECHOLOGISTS may change subscription pricing or included features by providing appropriate notice before the change applies to a future billing period.

Tutoring and Educational Services
Tutoring and other educational services are provided to support learning.
Participation does not guarantee:
- examination success;
- certification;
- registration;
- employment;
- academic credit;
- clinical competence;
- acceptance by an employer;
- acceptance by a school;
- acceptance by a regulatory body; or
- a particular professional result.
Users remain responsible for understanding the requirements imposed by their educational institution, credentialing organization, professional association, employer, or regulator.
Tutoring does not create a healthcare professional–patient relationship and must not be used to obtain personal medical advice.

Testimonials and Educational Outcomes
Testimonials, reviews, learner comments, engagement statistics, or examples of past outcomes reflect individual experiences.
They do not guarantee that another user will receive the same result.
ECHOLOGISTS may edit testimonials for length, grammar, clarity, formatting, or removal of identifying information without materially changing their meaning.
Permission will be obtained where required before publishing a non-public testimonial with identifying information.

Third-Party Content and Services
ECHOLOGISTS may link to or embed third-party websites, articles, guidelines, videos, products, publications, social-media posts, software, payment tools, and services.
Third-party content is provided for convenience or educational reference.
ECHOLOGISTS does not control and is not responsible for:
- third-party availability;
- accuracy;
- security;
- accessibility;
- privacy practices;
- purchases;
- policies;
- later changes; or
- user interactions with those services.
A link, mention, collaboration, or embed does not necessarily constitute endorsement of every statement, product, policy, or activity of the third party.

Website Availability
ECHOLOGISTS may modify, update, suspend, restrict, or discontinue any feature or content.
The website may experience:
- maintenance;
- service interruptions;
- technical errors;
- compatibility problems;
- data loss;
- security events; or
- third-party outages.
ECHOLOGISTS does not guarantee continuous or error-free availability.
Reasonable efforts may be made to correct significant technical issues, but no particular response or restoration time is guaranteed.

Disclaimer of Warranties
To the extent permitted by law, ECHOLOGISTS content and services are provided on an “as available” and “as is” basis.
ECHOLOGISTS does not guarantee that:
- all content is complete;
- all content is current;
- every interpretation is appropriate for every setting;
- the website will always be available;
- every file will be compatible with every device;
- all errors will be corrected;
- use will produce a particular educational result; or
- third-party content will remain available or accurate.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

Limitation of Liability
To the extent permitted by applicable law, ECHOLOGISTS will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from:
- reliance on educational content without appropriate professional review;
- unauthorized use of materials;
- user-submitted content;
- third-party websites or services;
- interrupted access;
- loss of data;
- account misuse;
- device incompatibility; or
- actions taken outside a user’s authorized professional scope.
Where liability cannot lawfully be excluded, it will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited, including liability arising from fraud or intentional misconduct.

Privacy
Personal information is handled according to the ECHOLOGISTS Privacy Policy.
By using third-party payment, embedded-media, social-media, or external services, you may also be subject to the third party’s privacy policy and terms.

Suspension and Termination
ECHOLOGISTS may suspend, restrict, or terminate access where reasonably necessary because of:
- a material violation of these Terms;
- unlawful activity;
- unauthorized sharing;
- intellectual-property infringement;
- payment reversal or non-payment;
- security risk;
- misuse of patient information;
- harassment or abuse; or
- conduct that threatens the website, ECHOLOGISTS, users, or third parties.
Where appropriate, ECHOLOGISTS may provide notice or an opportunity to correct the issue. Immediate action may be taken where delay could create harm, legal exposure, or security risk.
Provisions concerning intellectual property, submissions, payment obligations, disclaimers, limitations, and dispute resolution may continue after termination where their nature requires.

Governing Law
These Terms are governed by the laws applicable in Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection or jurisdictional rights, disputes relating to these Terms or ECHOLOGISTS will be submitted to the courts located in Ontario, Canada.

Changes to These Terms
ECHOLOGISTS may update these Terms to reflect:
- changes to services;
- new features;
- payment changes;
- operational requirements;
- security concerns;
- legal requirements; or
- clarification of existing provisions.
The updated version will be posted with a revised date.
Continued use after an updated version becomes effective constitutes acceptance where permitted by law. Where a material change requires additional notice or consent, ECHOLOGISTS will provide it as appropriate.

General Provisions
If one provision is found invalid or unenforceable, the remaining provisions will continue to apply.
A failure by ECHOLOGISTS to enforce a provision immediately does not waive the right to enforce it later.
These Terms, together with the Privacy Policy, Medical Disclaimer, checkout disclosures, and any service-specific terms, constitute the applicable agreement concerning use of ECHOLOGISTS.
